  • Shocking lack of insight

Listening to the arguments (Basically right wing political justification) of these two especially Ken McDonald on the indefinite detainment of the Palestine hunger strikers before trial was terrifying: these are people who are being detained indefinitely without conviction for property damage. At the same time our justice system routinely releases convicted domestic abusers and murders after not even serving half the sentences they have been given by a court after conviction. We seem to be no di... more

  • Chinese prejudices

The latest Double Jeopardy podcast, examining the reason why the prosecution against the two gentleman accused of passing sensitive information to the People’s Republic of China was withdrawn, is of special interest to me living, as I do, in Hong Kong China. It reveals the inherent prejudice within the English population and in particular the politicians to China. I hope that a wide audience listens to the discussion. It may expel some prejudice. it’s nice to have Double Jeopardy, a thoughtful a... more

Talking Points

Recent interactions between the hosts and their guests.

Listeners’ Mailbag: Tariffs, Hunger Strikes and Undermining the Parole Board
Q: What are the circumstances in which the government can hold prisoners remanded beyond the standard custody time limit?
The government can keep prisoners in custody beyond the standard 182 days if the seriousness of the offense and the fear of re-offending justify the decision, with the courts having discretion to extend custody time limits under certain conditions.
Living in the Southern Ocean: Part 1- Blazing a Trail for Criminal Justice Reform
Q: What drove the changes in the New Zealand justice system?
Simon attributes the changes to addressing a massive backlog of trials and enhancing public confidence in the justice system.
Mr Lammy Goes to Strasbourg- and our Christmas Listeners’ Postbag on Jury Reforms
Q: Are you seriously suggesting that the hundreds of thousands of litigants that pass through the commercial family and administrative courts every day aren't getting fair trials?
Ryan notes that judges regularly make critical decisions in severe matters, questioning the fairness of not having jury trials in certain cases, suggesting an honest discussion about how jury trials could be reformed.
Are the Courts Flinching on Article 8? And Who’s Trying to Kill the Assisted Dying Bill in the House of Lords?
Q: Does that hold any weight?
It is not far-fetched; the laws on terrorist financing mean that publicly declaring an intention to fund a terrorist organization could be considered strong evidence of knowledge or suspicion by legal standards.
Why Did The Chinese Spying Case Really Collapse? Double Jeopardy Receives a Leaked Copy of the Defence’s Expert Report and an Exclusive Interview With Its Author, Professor Kerry Brown (who was not the source of the leak!)
Q: What was the basis for the collapse of the case?
Brown suggests that the collapse may have stemmed from evidential insufficiencies regarding national security and the prosecution's inability to substantiate claims about the importance of Berry and Cash's activities.
