  • The recent addition of Kate Klonick

I’ve appreciably gotten used to a certain level of professionalism among the hosts and commenters. Ms. Klonick’s repeated use of “like” and squeals and over-the-top emotional outbursts ain’t that. Could you tone it down a bit? My ears hurt…

  • “Sweet Dreams…”

So at least one of you thinks it’s just fine for a masked plainclothes person to snatch anyone they want off the street and do who knows what to that person because nobody knows who or what the snatcher is.

  • No more “ew” factor, please.

I’d like Ben to leave his women issues out of the podcast. He makes a point of “joking” that one episode was all men — “And NO women!” he repeated. We get it: you had a domestic spat and so now we all need to hear about it. I’ve also found it strange that Ben should regularly (and uncomfortably) flirt with a female reporter during episodes. Ew. Just stick to the facts and legal cases, please. That’s why we listen.

  • A voice coach. Right?

Any chance someone could voice-coach Chris Mirasola to break his “Right?” habit? (That’s saying “Right?” every other sentence.) This verbal tic is getting more and more common these days and, while it might be an overcompensation for momentary insecurity, I find the habit super annoying (enough to fast-forward through a speaker’s comments). In the case of this panelist, voice coaching might also help his general delivery, which can be a bit hard to follow.

Talking Points

Recent interactions between the hosts and their guests.

Lawfare Daily: Scott Anderson on How Social Media Platforms Should Handle Unrecognized Regimes
Q: So how did the different platforms, just to sort of give a preview and we'll get into all the issues as we continue the conversation, but might just be helpful to start with a sense of how in that specific case, the different platforms treated this and how in particular they may have diverged in how they treated the particular issue of the Taliban in 2021?
You saw kind of two dominant strategies emerge really early on. The majority of platforms like Facebook and Google approached it through the lens of sanctions compliance, while Twitter maintained a position that allowed account access based on conduct rather than status alone.
Lawfare Daily: The Trials of the Trump Administration, Dec. 5
Q: Could time to litigate Richmond's suit make it impossible for EDVA to get an indictment simply because the six-month clock on a re-indictment will have run out?
Some factors could complicate whether they can indict within the timeline due to ongoing litigation about evidence gathering.
Lawfare Daily: America's Defense Industrial Base
Q: How do you think about a division of labor when it comes to friends who might be helping us with common tasks?
The U.S. should leverage its allies for shipbuilding capabilities, especially for non-sensitive assets, acknowledging that countries like Japan and South Korea can produce high-quality ships more efficiently than the U.S.
Lawfare Daily: America's Defense Industrial Base
Q: Can you explain why this is, at least potentially, such an important development when we think about the defense industrial base?
The rise of private equity and venture capital is opening new funding avenues for defense-related technologies and companies, reflecting a shift in how defense is financed, especially with increased interest from firms in innovative sectors like AI and biotech.
Lawfare Archive: AI Regulation and Free Speech: Navigating the Government’s Tightrope
Q: How does this change in the case of AI agents where that output might take the form of code or other instructions that are translated directly into actions in the real world?
It's plausible that generative AI output may not be considered speech when it comprises actions rather than human communication. Programs that execute code autonomously may fall under regulation rather than First Amendment protection.
